At its December meeting the SELF Board of Directors resolved a longstanding coverage issue by declaring its intent to treat as a single “occurrence” claims that involve an alleged act or series of continuous, repeated, or related acts by a single wrongdoer, even if there are multiple claimants. This includes the Board's intent that in cases involving alleged continuous, repeated or related acts by a single wrongdoer that continue through more than one, one-year coverage period, only one year's limit, and not multiple limits will apply. This will apply to all claims that are still open, and have not yet been concluded by settlement or judgment as of December 1, 2006. The decision was reached after careful consideration and study, which included a detailed report to the Board by SELF's broker, Marsh Risk & Insurance Services, and input from the re-insurers that the JPA contracts with. |
